Eminem Files Legal Challenge Against Australian Beachwear Brand 'Swim Shady'
US rapper Eminem has initiated legal proceedings against an Australian beachwear company named Swim Shady, claiming the brand’s name creates an unauthorized connection to his famous Slim Shady persona. The 53-year-old artist, whose real name is Marshall B Mathers III, filed a petition with the US Patent and Trademark Office seeking to cancel the trademark held by the Sydney-based company. His legal team argues that the name ‘Swim Shady’ creates a ‘false association’ with Eminem’s well-known rap alter ego, which he trademarked in the US in 1999. The company, which sells beach accessories including portable umbrellas and swim bags, registered its name in Australia in September 2023 after initially launching under the name ‘Slim Shade’ and officially rebranding in 2024. They recently obtained a US trademark for ‘Swim Shady,’ prompting Eminem’s legal action. Swim Shady has stated it will ‘defend our valuable intellectual property’ and is represented by Sydney-based intellectual property law firm Meyer West IP. The company explained that it was founded with the intention of creating stylish sun protection products for the Australian climate. Eminem’s lawyers emphasized that ‘Slim Shady’ has become a ‘distinctive and famous’ brand exclusively associated with his music career. The case bears similarities to a recent Australian court ruling that favored singer Katie Perry in a trademark dispute against Australian designer Katie Perry. Eminem’s legal team is also pursuing a similar challenge in Australia, where he only recently filed for trademark protection of ‘Slim Shady’ in January 2025.
